Terms of Service

These Terms of Service ("Terms") are an agreement between you and Foundative Inc., a Delaware corporation ("Foundative", "we", "us"), and govern your access to and use of Result (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you are agreeing on its behalf and confirming you have the authority to do so.

1. What Result is

Result is an AI-assisted workspace for running a business online: an agent you chat with, a knowledge base for your business ("Company Brain"), tools for building and operating your web presence, and integrations for publishing content, running ads, taking payments, and supporting your customers through connected third-party accounts.

2. Accounts

You need a Google account to sign in. You are responsible for the activity that happens under your account and for keeping your credentials secure. Tell us right away if you suspect unauthorized access. One account may hold more than one business workspace; you are responsible for everything done under any workspace you control.

3. Subscriptions and billing

Paid features are billed on a subscription basis at the price and interval shown at checkout. Fees are billed in advance and, except as described in our Refund Policy, are non-refundable. You can cancel at any time; cancellation stops future billing but does not refund the current billing period. We may change our prices with notice; continuing to use the Service after a price change takes effect means you accept the new price.

5. Connected third-party accounts

Result lets you connect accounts on other platforms, such as social networks, advertising platforms, email providers, and payment processors, so the Service can act on your behalf (for example, publishing a post or reading campaign performance). Your use of those platforms remains subject to their own terms. We are not responsible for their availability, accuracy, or actions, including changes they make that affect a feature built on top of them.

6. Your content

You retain ownership of the content you create, upload, or connect through the Service, including business data, documents, blog posts, and messages ("Your Content"). You grant us a license to host, process, and display Your Content solely to operate and improve the Service. You are responsible for having the rights needed to give us that license and for the legality of Your Content.

7. AI-generated output

Parts of the Service use AI models to generate or summarize content, answer questions, and take actions you direct. AI output can be inaccurate or unsuitable for a given purpose. You are responsible for reviewing AI-generated output before publishing it, sending it to a customer, or otherwise relying on it.

8. Intellectual property

Result, including its software, design, and branding, belongs to Foundative and its licensors. These Terms do not grant you any rights to our trademarks or branding. Feedback you give us about the Service may be used without restriction or compensation.

9. Termination

You can stop using the Service and delete your account at any time. We can suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service, with notice where reasonably possible. Sections that by their nature should survive termination (including billing for amounts already owed, ownership, disclaimers, and limitation of liability) survive.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated output will be accurate or complete.

11. Limitation of liability

To the maximum extent permitted by law, Foundative is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the twelve months before the claim arose.

12. Indemnification

You will defend and indemnify Foundative against claims arising from Your Content, your use of the Service in violation of these Terms, or your violation of a third party's rights.

13. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms as the Service evolves. We will post the updated Terms here and update the date at the top of the page. Continued use of the Service after a change takes effect means you accept the revised Terms.
